Perkembangan dan Peranan Mogok di Malaysia: Satu Kajian Awal

Abstract


IKHTISAR: Kertas kerja ini – dengan mengguna-pakai kaedah sejarah, pendekatan kualitatif, dan sorotan literatur – menghuraikan fenomena mogok yang berlaku di Malaysia. Penjelasan dilakukan terhadap pengertian mogok, beberapa peristiwa mogok, peranan kesatuan dalam mogok, dan implikasinya terhadap perhubungan perusahaan. Dapatan kajian menunjukan bahawa mogok merupakan salah satu bentuk tindakan perusahaan oleh para pekerja bagi menuntut hak dan keperluan mereka di tempat kerja. Mogok yang dilancarkan oleh pekerja adalah untuk menekan pihak majikan agar menerima cadangan dan tuntutan mereka, manakala pihak majikan pula berperanan untuk mengawal mogok agar tidak berpanjangan dan pihak kerajaan berperanan sebagai “penyelesai masalah” jika pertikaian tidak dapat diselesaikan. Kesan dari interaksi ini menyebabkan bilangan mogok semakin berkurangan; sebaliknya, corak pertikaian perusahaan lebih cenderung berbentuk individu, seperti pembuangan pekerja. Namun begitu, para pekerja tetap melancarkan tindakan perusahaan dalam keadaan-keadaan tertentu seperti piket dan “go-slow” bagi menyuarakan bantahan mereka terhadap pihak majikan. Kenyataan tersebut membuktikan bahawa fenomena tindakan perusahaan, seperti mogok, akan terus berlaku sebagai satu manifestasi ketidakharmonian dalam perhubungan perusahaan di Malaysia.

ABSTRACT: “The Development and Function of Strike in Malaysia: An Introduction”. This paper – using the historical method, qualitative approach, and literature review – attempts to elaborate the phenomena of strike in Malaysia. It will be explained the meaning of strike, strike cases, the roles of trade union in strike, and the implications to Malaysian industrial relations. The findings show that strike is one of the forms of corporate action by workers to claim their rights and needs at work. The purpose of strike is mainly to repress the employer to agree with trade union proposal during the process of collective bargaining, while the employer responsible to confirm that strike not take long time and the government function as a “problem solver” if the disputes failed to reach any decision. This cycle finally transformed the nature of dominant disputes from strike to dismissal cases. Nevertheless, in certain situations, trade unions still conduct industrial action, such as picket, go-slow to show they objection with the employer. This proved that the industrial action phenomena, like strike, will be continuously happened as one of manifestation to break the industrial harmony in Malaysia.
